Five Attorney Tasks Involved in a Closing

I assist clients with real estate closing. I  work with you, your lender, and your agent to ensure a successful transaction. Communication and coordination are critical to prepare for successful and timely closing. We also ensure your rights are protected long-term.

Title Examination: It’s our job to pore over local court records and make sure there are no unresolved claims or liens on the home’s title. We’ll work to resolve any issues or inconsistencies and even order a survey, if the previous one is out of date.

Title Insurance: Even the most detailed title investigation isn’t infallible. We’ll insure you and your lender against unexpected title issues and the financial devastation they could bring.

Closing Coordinator: We also integrate into your home buying team, working with you, your lender, and your agent to prep the closing paperwork.

Document Preparation: We stay up on changes in local real estate laws to make sure all of your documents comply. With all your questions answered and paperwork ready, we’ll synchronize the buyer, seller, and agents to schedule the final closing.

We’ll also handle getting all the checks, deeds, affidavits, and authorization letters for the big day.

Record Denouements and Disburse Funds 

As your settlement coordinator, we act as a neutral third-party to oversee the transaction.
We not only make sure i’s are dotted and t’s are crossed, we collect funds, hold them in escrow, and disburse them on time.After your smooth settlement, we file the deed and documents with the county for posterity. You head off with the keys to your new home and we head to the courthouse.

The Settlement Attorney’s Role

The settlement (also called a closing) is the conclusion of the real estate transaction. This is the point when the buyer’s and lender’s funds are put in an escrow account and the lender’s documents are signed by the buyer and seller. At settlement, the parties sign a Closing Disclosure statement, which is the settlement document used nationwide to disclose, in line-item detail, all financial adjustments, amounts due and disbursements pertaining to the transaction. Assuming final numbers are available , the parties receive a copy of the Closing Disclosure statement for review on the day before Closing.

How long does closing take?

The closing process starts when you sign a  purchase and sale agreement. That agreement usually includes a closing date, which is the date when the deal will be finished. It typically takes four to six weeks. This is the time period is often called “escrow.” During that time your real estate agent, the title company and/or real estate attorney, and your lender will be working together to finalize all the documents and paperwork.
